Moscow District Federal Arbitration Court dismisses Russia's Federal Anti-Monopoly's cassation petition filed against CenterTelecom

Moscow, January 18, 2011. Moscow District Federal Arbitration Court has dismissed a cassation petition filed by Russia's Federal Anti-Monopoly Service against Moscow Arbitration Court's ruling and Ninth Arbitration Appellation Court's decision which canceled the Federal Anti-Monopoly Service's decision and order on breach of anti-monopoly legislation by CenterTelecom.

EDN Sovintel LLC sent a claim to the Federal Anti-Monopoly Service regarding breach of anti-monopoly legislation by CenterTelecom. The claim's main point was in an imposition of disadvantageous conditions of interconnection of EDN Sovintel LLC's network to CenterTelecom's local networks in Tula, Orel and Voronezh. In accordance to these conditions EDN Sovintel LLC had to transfer traffic only from the telephone numbers included in numbering scheme of its network and other operators' networks interconnected to EDN Sovintel LLC's network (if the operators have such right indicated it their licenses).

In accordance with the Federal Anti-Monopoly Service's decision dated October 19, 2009, CenterTelecom was recognized breaching of the Federal Law "About Competition Protection" as it refused to amend the interconnection agreements with regard to traffic transfer and as it refused to transfer AK CNIISU OJSC's traffic through EDN Sovintel LLC's network.

However on May 5, 2010 Moscow Arbitration Court invalidated Russia's Federal Anti-Monopoly Service's decision and order on breach of anti-monopoly legislation by CenterTelecom. Russia's Federal Anti-Monopoly Service and EDN Sovintel LLC filed petitions for appeal to Ninth Arbitration Appellation Court. On October 23, 2010 Ninth Arbitration Appellation Court sustained Moscow Arbitration Court's ruling and dismissed the petitions for appeal. On January 11, 2011 Moscow District Federal Arbitration Court also dismissed a cassation petition filed by Russia's Federal Anti-Monopoly Service.
